People Change. These changes often lead to a break down of the relationship and become the reason many marriages dissolve. If your traditional or same-sex marriage is beyond reconciliation, you need to get an attorney as soon as possible to protect your rights regarding assets, debts, child custody, and support.
People cheat. Although cheating is the most common reason for a divorce, Oklahoma does not take into account cheating when dividing assets or child custody. Oklahoma will divide these assets in accordance to what the judge deems "equitable." This means your spouse may end up with an ownership interest in your business or obtain part of your inheritance if you commingled those assets. People have children. Child custody is essentially the decision-making aspect during the child's upbringing. This involves deciding which school to attend, which doctors to see, and what extra-curricular activities the child should be involved in. One party can have sole custody or the parties can have joint custody. This determination is based on the best interests of the child.
People want to see their kids. Visitation is the time each parent spends with their child. Visitation can be split between the parties 50/50 or split more to one party based on the best interest of the child. Some of the factors considered are the child's school schedule, parents' work schedules, and parents' criminal history.
People have to provide for their children. Oklahoma requires parents to financially provide for their children. Child support will be calculated based on the parents' gross income and the visitation schedule.
Many people don't need a divorce. If you have children outside of a marriage, you will need to file a paternity case to get a legal order for child custody and visitation. Although DHS can assist with child support, DHS cannot grant orders for custody and visitation. Therefore, you need to get us involved so we can properly establish your rights to your children.
